General Conditions of Use


GECINA, a public limited company with capital of €573,949,530, registered in the Paris Trade and Companies Register under number 592 014 476, whose registered office is located at 14-16 rue des Capucines, 75002 PARIS, through its Explore Youfirst Bureau website, enables its users to view descriptive sheets (‘decks’) of each of its buildings with surface areas currently being marketed, to access a personalised selection of buildings, personalised documents and also to contact Gecina.

By means of these general terms and conditions of use (hereinafter referred to as the ‘GTCU’), Gecina (hereinafter referred to as the ‘Publisher’) reminds the user (hereinafter referred to as the ‘User’) of the essential rules governing the operation of the Explore Youfirst Bureau site (hereinafter referred to as the ‘Site’).

By accessing this Site, the User undertakes to comply with these GCU.

 

Acceptance - Enforceability - Entry into force of the GCU


By accessing this Site, the User acknowledges having read these GCU and undertakes to comply with them. Access to the Site by the User implies acceptance of the GCU, which can be accessed at any time on the Site by clicking on the link provided for this purpose.

The Publisher reserves the right to modify them at any time, in particular in order to adapt them to changes on the Site. The User therefore undertakes to consult them regularly. They are deemed to accept the latest version each time they connect to the Site.

The new Terms and Conditions will come into force on the date they are posted on the Site. The new GCU are binding on the User, who may consult them at the time of connection and at any time by referring to the ‘general conditions of use’ section. The GTCU appearing online take precedence over any printed version of an earlier date.

The User declares :
- He/she is of legal age,
- they have the skills and resources required to use the Site and to become a User,
- that they have the full capacity to commit themselves,
- they have been informed that their commitment does not require a handwritten or electronic signature.

The User has the option of saving, editing and printing these GCU. The User declares that he/she has obtained all necessary information from the Publisher regarding the operation, access and use of the Site and accepts these GCU unreservedly.

 

Purpose


The purpose of the Site is to enable the User, remotely and free of charge :
- to view the description sheets (‘decks’) for each of the properties with surface areas currently being marketed
- Access a personalised selection of properties
- Access personalised documents
- Contact Gecina.

The steps or requests of the User, as well as all exchanges of information or documents between the User and the Editor, via the Site are subject to the provisions relating to electronic mail of articles 1125 to 1127 and 1127-4 of the French Civil Code.

 

Accessibility of the Site


Access to the Site is possible from any location for any User with Internet access. It is free of charge (excluding the cost of Internet connection and telephone communications).

This Site is accessible 24 hours a day, 7 days a week, except in the event of force majeure, computer breakdowns or problems linked to the telecommunications networks, acts of third parties and/or maintenance work and interventions necessary for the proper operation of the Site. In such cases, this interruption will be notified by means of a warning on the home page or by any other means. The Publisher may not be held liable for any such interruption and shall not be entitled to any compensation.

Access to the Site is via a URL link sent by the Publisher to the User. This link may be deactivated by the Publisher at any time and without prior notice.

 

Liability


 The Publisher is subject to an obligation of means and is only liable for direct damage. Thus, neither the Publisher, nor its directors, employees or other representatives may be held liable for any inability to access the Site due to the particular configuration of the User's computer or access to the Internet network.

Generally speaking, the Publisher may not be held liable for the quality of the service, disruption to the use of the Site, the impossibility of using it, or breaches of computer security that may cause damage to the User's computer equipment and data.

The User acknowledges that, notwithstanding the Publisher's best efforts, the Internet and telecoms networks have technical characteristics that make it impossible to guarantee uninterrupted access to the Site and response times.

The Publisher cannot be held responsible for any viruses that may infect the computer or any other computer equipment of the Internet user, following use, access or downloading from the Site.

Intellectual property rights


 The content of the Site is the full and entire property of the Publisher. This Site must be considered as an indivisible whole. All the elements contained herein (information, data, text, sound, images, drawings, graphics, distinctive signs, logos, trademarks, etc.) and, in general, all the information and/or documents contained in and on the Site, as well as all the elements created for the Site, are either the exclusive property of the Publisher, or are subject to exploitation, use, reproduction and/or representation rights granted to the Publisher.

When using the Site's contact form, the Publisher collects various personal data supplied by Users.

Applicable law and jurisdiction

In the event of a dispute or claim arising from the User, the Publisher or a third party, only the current version of these GCU accessible on the Site will be binding between the parties, regardless of the date of the facts complained of.

The fact of not applying a stipulation of these GCU shall not be considered as acceptance of the violation, non-performance or subsequent breach of the said stipulation.

ANY DISPUTE, CONTROVERSY OR LITIGATION RELATING TO THE CONCLUSION, PERFORMANCE OR TERMINATION OF THESE GUS SHALL BE GOVERNED BY FRENCH LAW. THIS SHALL APPLY TO BOTH SUBSTANTIVE AND PROCEDURAL RULES, REGARDLESS OF THE PLACE OF THE DAMAGE, THE NUMBER OF DEFENDANTS, EVEN FOR EMERGENCY PROCEEDINGS OR PROTECTIVE PROCEEDINGS IN CHAMBERS OR BY PETITION, UNLESS OTHERWISE PROVIDED BY PUBLIC POLICY. THE FRENCH COURTS WILL HAVE JURISDICTION FOR INTERNET USERS LOCATED ON FRENCH TERRITORY.
